Novas Medidas Provisórias: Impactos na jornada de trabalho

Estamos vivendo um momento de mudanças repentinas, por conta da pandemia do Covid-19. Para ajudar sua empresa a entender e aplicar as novas medidas provisórias, a ADP convidou Oscar Salomoni, diretor de Suporte Técnico da ADP, para falar sobre os impactos na jornada de trabalho no banco de horas e suspensão de férias.
A medida provisória 927 trouxe algumas alterações, visando à flexibilização de aspectos relacionados à jornada de trabalho durante a pandemia. Uma delas permite a compensação do banco de horas, no prazo de até 18 meses, após o encerramento do estado de calamidade pública. Para clientes ADP que já possuem banco de horas, destacamos que o eXpert está pronto para atender à essa prorrogação, conforme prazo previsto pela medida provisória.
O decreto permite, ainda, que o empregador suspenda férias ou licenças não remuneradas dos profissionais da área de saúde, ou daqueles que desempenham funções consideradas essenciais. Para isso, deve haver uma comunicação formal da decisão ao trabalhador, por escrito ou por meio eletrônico, com antecedência de até 48 horas, sempre respeitando o período mínimo de gozo de 5 dias.
Como a medida provisória refere-se somente ao período de calamidade pública, Oscar aponta que, “um ponto importante, para avaliar junto com o seu departamento jurídico, é com relação ao saldo em banco de horas, referente ao período anterior a 20 de março de 2020. Uma interpretação mais conservadora apontaria para a quitação do período anterior ao estado de calamidade pública e o início de um novo banco de horas já em conformidade com as novas regras”.
